MOCO 7 HIT WITH MULTIMILLION DOLLAR DISCRIMINATION LAWSUIT

My fellow Citizens,

I am sure that you thought that the corruption that we heard about a couple of weeks ago in Prince Georges County was the worse thing that could have  happen within our region at this time.  I would venture to say that you have seen nothing yet when you find out what is happening in  Montgomery County,  the neigboring county.  We have 7 county employees in high level positions that should have know better, who conspired and violated the civl right of one of its citizen which has resulted in a multi million LAWSUIT.  In this hard times Steve Hayes, Real Estate Specialist, Cynthia Brenneman, Director of Real Estate, Shridhar Gondhalekar, Architect, Project Manager, Eileeen Basaman, Associate Attorney, in the Montgomery County Attorneys Office, in collusion with Patricia Via, Chief Litigator, Paul Leonard, Associate Attorney,  and Timothy L. Firestine, Chief Administrative Officer for Montogmery County, who I will call the MOCO 7 felt they could act without the fear of law by bankrupting an African Amercian Woman who happens to be a single mother that was pursing the American dream out of business and soon to be homeless.

To refresh your mind, please read the entire blog which details how this seven individuals conspired and drove me out of business because they did not want to execute a contract to rent the building now being used as the TRIPS OFFICE,( NOT TO BE CONFUSED WITH LINDA TRIPP) located at 8413 Ramsey Avenue, which I have dubbed  the 8413RamseyGate from a Black Woman. Their preference was to do business with the white owners of the building.  One might say that of course they had the right to not want to deal with a Black Woman, after all this America, we have the Freedom to do as we please, RIGHT?

They forgot about

WHICH STATE AS FOLLOWS:

All persons within the jurisdiction of the United States shall have the same right in every State and Territory to make and enforce contracts, to sue, be parties, give evidence, and to the full and equal benefit of all laws and proceedings for the security of persons and property as is enjoyed by white citizens, and shall be subject to the like punishment, pains, penalties, taxes, licenses, and exactions of every kind, and to no other.

THEY ALSO FORGOT ABOUT 

42 U.S.C. § 1983
(Civil Rights Act of 1866

Which provides that anyone who, under color of state or local law, causes a person to be deprived of rights guaranteed by the U.S. Constitution, or federal law, is liable to that person.

They also forgot about or were ignorant of 

Title VI of the Civil Rights Act of 1964 42 U.S.C. § 2000d et seq.  It prohibits discrimination on the basis of race, color, and national origin in programs and activities receiving federal financial assistance.

As President John F. Kennedy Stated in 1963:  Simple justice requires that public funds, to which all taxpayers of all races [colors, and national origins] contribute, not be spent in any fashion which encourages, entrenches, subsidizes or results in racial [color or national origin] discrimination.

 

In the MOCO 7s' excitement in finding a Black Person that they could treat like a non-person who they felt had no rights or protection under the law, they forgot that they were interfering with a business contract and relationship as well as fraudulent misrepresentation.  They forgot that ignorance is no defense for breaking the law.

Let me reiterate that these 7 individuals could have done the right thing by buying out my present lease or coexisting in the building with me.  But they felt that they were above the law and could  do as they please without any fear of reprisal.  As I have stated before this is a modern day hanging of an African American Person.  The Noose represented by the trickery of the MOCO 7 to make sure that I would run out in the street naked and loose my mind so that I would be labeled as mentally unsound.  

I would not have been able to proof anything if it was not that I was able to get my hands on the LEASE they executed with Joseph and Jeanne Godbout, and Robert and Virginia Medbery owners of 8413 Ramsey Avenue which I have again enclosed for your edification. It did not bother them that when I met Mr. Steve Hayes who was acting on behalf of the county that I had a lease on the premises since 2005 and was current in my lease payment.  He and his Co-conspirators had no concience or concern about the amount of harm they could cause or would be causing to another fellow human being.  Oh I forgot since I am Black, I am classified as a complete human being.

It is heartbreaking to find out that the government you believed in, deceived, committed perjury, discriminated against YOU and was willing to interfere in a business relationship in order to show that they were big and mighty.  I might even venture to say that upon further investigation that they may have committed civil Rico.  Shocking news I am sure.  The Montgomery County attorneys office in Conjunction with the Circuit Court was a willing partnership in accomplishing this horrendous dead to one of its citizen that was just out there building the American Dream.

During the first hearing, Attorney Paul Leonard said that The Montgomery Executive was the only one who could bind the County into a contract.  I know that to them I may not be intelligent, but according to the LEASE I entered into evidence to show that they had absolutely no intention of doing business with an African American woman, I do not see the Honorable Ike Leggett signature on that lease. Is there another lease with his signature that we have not been made aware of?   I guess he felt that since he had friends at  the Circuit Court level, he could COMMIT PERJURY ALL HE WANTED.  After all Attorney Paul Leonard and Attorney Patricia Via are guaranteed that they will always get a salary which is paid for with our tax dollars no matter what type of atrocity the commit.  

They felt that they could get away with a modern day lynching, after all they were, and are not accountable to anyone. They are not even accountable to the Tax Payers that Pay them the salary that enables them to abuse their position of trust.What is an individual suppose to do when they cannot even trust in the government or system that is suppose to protecting them from some of the madmen that call themselves Montgomery County Employees.  How do I tell my child that we have lost our home, and business is because the Montgomery County Attorney Office and the Department of Real Estate decided to play Russian Roulette with our lives.   

Ethics is for Everyone else to abide except the Montgomery County Government

 In 1997, the County Council for Montgomery County passed legislation to create the Inspector General’s Office to serve as a watchdog to detect and prevent fraud, waste, and abuse in County government operations:

The goals of the Inspector General are to: 1. review the effectiveness and efficiency of programs and operations of County government and independent County agencies; 2. prevent and detect fraud, waste, and abuse in government activities; and 3. propose ways to increase the legal, fiscal, and ethical accountability of County government departments and County-funded agencies. Even the Prior leader of the County Attorneys office Leon Rodriguez defined the job of the Office of the Inspector General in a 2007 copy of  Legal View Publication  as follows:   Fraud A dishonest and intentional course of action that results in obtaining money, property, or an advantage to which the individual committing the action would not normally be entitled. Waste The needless, careless, or extravagant expenditure of County funds, incurring of unnecessary expenses, or misuse of County resources or property. Abuse The intentionally wrongful or improper use of County resources that can include the excessive or improper use of one s position, in a manner contrary to its rightful or legally intended use. Would you not say that the abuse the County Attorneys Office and the Department of real estate has put me thru deserves an investigation by this office as well as the State and Federal Government?   Keep in mind that all mailings to alert the proper authorities of the intentional bankrupting of me and destruction of my business and personal life has been brought to the attention of this office several times through mailings that I sent to each of the council members since 2007 the Inspector Generals Office.    Keep in mind that the building of the Paul Sarbanes Transit center was funded by local, state as well as Federal funds which prohibits discrimination.  The building of this center was a concerted effort of Montgomery County, Maryland, and Washington Area Transportation Authority.  I think that most of you know where I am going with this.   Even Montgomery County prohibits Discrimination.  According to the Department of Human Rights, "The Office of Human Rights investigates incidents of hate/violence and complaints of discrimination. Victims of hate/violence crimes can seek compensation for replacement of property through the County's Partnership Fund, administered by the Office of Human Rights."  Their motto further states that it "creates a culture of service and a climate of fairness and inclusion."  I wonder if they really preach what they write, or it just looks good on paper.  : Would we classify the actions of Paul Leonard, Patricia Via, and Eileen Basaman in the County Attorney's office as "a hate incident"  or does this policy apply only to other people and exempts them from the hate and violence they caused for me? Would we classify the actions of Cynthia Brenneman, and Steve Hayes a "hate incident"    WHY NOT!  They hated the fact that an African American Woman had a business and happened to be in a building that they needed for the so call "County".  They were willing to go to the extent of committing racial discrimination to get that building.  But you say that is going too far.  Why would it be going to far?  All of the actors where caucasion.  I was the only African American.  I was the only one that the hate was directed at.  They committed Fraud. They Misrepresented their intent.  They Discriminated against an African American and a Woman, In addition they interfered with a business relationship.  Wow! And these are people we pay with our tax dollars!! Some of these people are actual attorneys with licenses who swore an oath to uphold the law.  These are the people we entrust with the day to day runnings of our Government.   Title VI of the Civil Rights Act of 1964 states that ”No person in the United States shall, on the grounds of race, color or national origin, be excluded from participation in, be denied the benefit of, or be subjected to discrimination under any program or activity receiving federal financial assistance.” 42 U.S.C. § 2000d Did they not know about this Civil Rights Act of 1964?  I think they knew and felt that they were exempt from the law.  After all who had oversight over them? The almighty Liberal Montgomery County.  They even felt so powerful that they felt they could COMMIT PERJURY in Collusion with the Circuit Court and get away with it.  During the first hearing of this case in the Circuit Court, Judge Pincus asked Attorney Paul Leoand if  he was ready to settle this case.  Of course he said no, that they had not broken any laws.  Well we now know that they knew that they had broken some laws that were worthy of a Watergate style coverup.  They felt that they were powerful enough, with no one looking for accountability from their office that they could lie, and cheat their way through any law.  Even if it meant breaking and destroying and bankrupting another human being.   If this incident had happened in Washington D.C. or Prince Georges County, we would be looking at the headlines and the fireworks.   Fellow Citizens it is time for us to call a spade a spade.  Even  Montgomery Council Member Trachtenberg wrote in a Letter that she sent to the United States Department of Justice that addresses the overreaching nature of the Montgomery Government with no oversight in place.   MORE IS TO COME..................................STAY TUNED............................................

Modern Day Lynching by The Montgomery County Government

Fellow Citizens:


I am sure we are familiar with the terminology Lynching.  The Britannica Concise Encyclopedia defines Lynching as the Execution of a presumed offender by a mob without trial, under the pretense of administering justice.  It says that in the United States, lynching was widely used in the post-Reconstruction South against blacks, often to intimidate other blacks from exercising their civil rights. 


Most of us are aware that this was done by killing the victim by slipping a noose through his or her neck and hanging him or her to a tree.  I am sure that most of us would believe that such acts could never happen in this Area we live in in Montgomery County Maryland.  


Fellow citizens, I am sorry to take you out of your comfort zone and tell you that it is still happening today.  Most of the time you will not find a noose around someones neck.  But you will find other subtle ways of making sure that an African American is intimidated into not exercising their civil rights.  How is this you ask? 

 I am sure that there are some African Americans who the noose above brings back memories of injustice of yesteryear that we hope never to see or hear someone in our lifetime experience.  There may be others who will say that I have gone too far in equating my treatment by the Montgomery County Government with the Assistance of the Montgomery County Circuit Court as going too far.  


But let me ask you, is it really going too far?  I do not think so.  Keep in mind that it is said that in the past, lynching was widely used in the post-Reconstruction South against blacks, often to intimidate other blacks from exercising their civil rights.  In the past believe it or not other blacks would remain silent while this injustice was going on in order to save their own neck and to be regarded as one of the good guys by the other racial group that were doing the lynching.  


My fellow Citizens, also remember that in the past most of the lynchings were done with the help of the law.  The Judges and those deputized to keep law would turn their head when the lynchings would take place.  Most of the time the Law would be the ones that would release the person to be lynched to the lynch mobs.  

People I do not have to say more.  Attorney Paul Leonard, Attorney Patricia Via, Attorney Eileen Basaman, Real Estate Specialist Steve Hayes, and Department of Real Estate Director Cynthia Brenneman of The Montgomery County Government together with the  Hon. Judge Rupp and Hon. Judge Ann Harrington  of  the Montgomery County Circuit Court cooperated and staged a  modern day lynching of an African American Woman and her dreams. They bankrupted me, they made me loose my home, and then they tried to intimidate me from speaking out.  A police detective Sgt. Kenneth Penrod called me to inform me that I should clear all my writings with him before I send them out.   And while this was happening, a couple of the government officials who happen to be African American just kept quiet in order to maintain their status quo. The Montgomery County Council kept quiet in order to maintain the status quo.  The Montgomery Council President Floreen decided to keep quiet. 


 The most shocking being Council Member/Council Vice President Valerie Ervin, who happens to be a single mother herself, who had the audacity to write an email that said that they the Montgomery County Council  took care of me two years ago, and that in addition they have a file on me.  I am still waiting for that file. In addition, I want to know how they took care of me.  Did  she mean that they made sure that the case at the Circuit court would be fixed and the county would COMMIT PERJURY in the name of destroying me so that they could get take over 8413 Ramsey Avenue.  A space that they could have had for the asking by just buying out my lease?  Did she mean that they took care of me by bankrupting me?  Did she mean that they took care of me by making me homeless?  Ms. Ervin how did you take care of me?  


Murdering or Stabbing a person is not the only way you can kill them.  You also kill a person when you take away their means of making a living.   My life was not worth beans to them.  I was expedient. After all, the nerve of an African American wanting to make money in Montgomery County was insulting to the powers that be, the old guard.  The notion of doing the right thing and doing business in an ethical and humane fashion was foreign to them, especially where an African American was concerned.  After all they had the backing of the Montgomery County Circuit Court to support them.  


I have shown you the Power Point that shows early in the game that 8413 Ramsey was their choice to house the Commuter Store.  This document I got when I was a member of the Urban District Council in Downtown Silver Spring.  I have shown you the 8413 RAMSEY AVENUE LEASE which shows that their intent was to get me out of that space by all means necessary.   I have shown you THE EMAIL  from the then Acting Director of the Department of Public Works Al. Roshdieh.  I have shown you THE EMAIL from the Montgomery Council Vice President Valerie Ervin.  I have shown the DEMAND LETTER from my Ex-Attorney.  I have shown you THE EMAIL from Sgt Penrod of the Montgomery County Police Department.  I have shown you the LETTER from Hon. Judge Ann Harrington.  I have shown you my RESPONSE to Hon. Judge Ann Harrington.  I have shown you the APPEAL TO THE COURT OF SPECIAL APPEALS.  I have shown you the LETTER from Attorney Paul Leonard attempting to shop for a Judge whose husband is a division chief in the Montgomery County Attorney's Office, and the ANSWER  I have shown you the LETTER from County Attorney Patricia Via to my Ex-Attorney referring the case to Schaffer Companies Ltd for investigation.  I have shown you THE LETTER written to several people in the community including the Montgomery County Council and the County Executive after the ground breaking ceremony for the commuter store at 8413 Ramsey Avenue letting them know that they had been caught in their lies. 


 They professed that they had no intention of renting that building.  Pray tell, why are you in there  now?  It is not a coincidence, it was premeditated murder, assassination, lies, and destruction of a human life and a family legacy.  All these documents speak for themselves.  They speak to the fact that the Montgomery County Government and their Cohorts thought that I had no voice.  They thought I had little or no intelligence.  I often tell people not to tell a book by its cover.  They thought they would be able to get away with the assassination of a life and a legacy without anyone being the wiser.  


These are the type of characters we entrust our live to.  Does not speak much to our Judgement.

THE SAGA CONTINUES AT THE MONTGOMERY COUNTY CIRCUIT COURT

Fellow Citizens,

I want to thank you for your time and patience as I continue with the Injustice I would never had believed was present and practiced in Montgomery County Maryland by the Montgomery County Government.

As I started writing this piece.  I was forced to reflect on the meaning of Justice.  What is Justice.  As I researched this term, I was able to find this definition, which is as close to what I believe Justice should be.

Justice ¹

Definition: The quality of being just; conformity to the principles of righteousness and rectitude in allthings; strict performance of moral obligations; practical conformity to human or divine law; integrity in thedealings of men with each other; rectitude; equity; uprightness. 


How should we apply the above definition to the proceedings of the Circuit Court in Montgomery County.  As I pondered through through this, I was forced to remember the treatment I received from the Judges, Clerks, Administrative Judges in the Circuit Court of Montgomery County.  I wonder how a man who has no education, no money can get justice without having a lawyer who is able to get an audience with a Judge at anytime, how a man who has no money to hire a Judge can get the same kind of back room, country club, knee slapping treatment from a Judge in the Montgomery County Circuit Court, that the Montgomery County Government was able to.  You and I know that this is not possible.  


But wait.  A Judge used to be a lawyer before he became a Judge, so who do we think his alliance will be with?  His alliance will be with another lawyer at anytime. The lawyer is his brethren, his fraternity brother or sister, his colleague.   If  a lawyer needs a favor from a Judge to fix a case, it will be easy to do so.  If a Lawyer needs a Judge to look the other way while he or she commits an atrocity it will be easy for him or her to do so because they come from the same yoke. 


I pondered on these thoughts as I was reviewing my experience with the actions of the Montgomery County Government in conjunction with the County Attorneys Office and the Montgomery County Circuit during my hearing  in  May 1 2008.    Once upon a time, I thought that this were separate entities.  I was wrong.  All the County has to do is to make a phone call, better yet just walk next door and get whatever they need even if means perjuring themselves under oath, while the Judge looks the other way.  After all they are brothers of the same cloth.  Fellow Citizens, that is what Attorney  Paul Leonard, and Patricia Via did on behalf of the Montgomery County Government.  They were willing to COMMIT PERJURY IN THE NAME OF EXERCISING ABSOLUTE POWER.  The Circuit Court was happy to help them do it.  First they tried to have  Honorable Judge Savage    hear the case, and then pulled her when they realized that it would not pass the smell test.  Especially as her husband was a division chief in County Attorneys office.  Of course they say that it was all coincidence.  Wow, of all the Judges in the Circuit Court they had to pick her by accident.  I guess they dropped me on my head when I was born.  


 further more I questioned the ruling of the hearing that took place on May 1, 2008.  I may have been mistaken, but the order that I received was not the same order that I heard when the Judge Rupp who was sitting on the case made his ruling.  Of course I wrote a letter challenging the ruling, to Ms Loretta Knight, the Clerk of the Court.  I have to say that she was very helpful and called me to inform me of her duties, and furthermore, she followed it up with a LETTER of explanation.  That was refreshing to say the least, after the totalitarian attitudes that I encountered at the Circuit Court of Montgomery County.  Having had experience in the Circuit Court and the Special Court of Appeals, it is strange that the Special Court of Appeals is more receptive to the common man without a lawyer than the Circuit Court of Montgomery County which is suppose to be closer to the common man.  Wow!


Fellow Citizens, Can you imagine that after I wrote the inquiry, that the judge who made the ruling never even had the courtesy to reply?  instead I get letter from the Honorable Ann S. Harrington.  An administrative Judge who was not even within earshot of the case.  In addition Judge Rupp was not sick, had not resigned, and was very much alive to either Deny or allow the challenge to the ruling of the case by both parties. Judge Harrington in her infinite wisdom decided that she was the JUDGE, JURY, AND EXECUTIONER.   "THE DECIDER", and sent me a LETTER to let me know that she is where the bucks stops even though she was not involved in the case .  "OH MY GOD."  "All power corrupts but absolute power corrupts absolutely." 


 How is it that a Judge who did not sit on a case, did not know anything on the case, sends a letter to me after I filed a motion to reconsider the accuracy of a judgement that was rendered by another Judge.  The Judge who rendered was not dead, had not retired, nor was he on vacation.  How could that be?  She was not at the hearing.  She was not the party that the case was appealed to?  How is that.  Could it be that she had been asked to step in as a favor to the County?  Things that make you ponder and go hmmmmmmmmmmmmmmmm..............


Fellow Citizens, I have now revealed to you the LEASE, which showed you that they knew they were lying all along.  They decided that as a favor to the County that it was easier to help them commit PERJURY than let the truth out.  Although I have tried from time to communicate the Lies to County Executive Leggett, he decided it was easier to ignore me.  After all who was I to question or challenge the County.

The Mafias are alive and well in Montgomery County Government

We have exposed the Montgomery County Government and their bureaucrats and elected officials for the hypocrites that they are.  The criminals that they are. If what they have done to me was done by a Republican Administration we would not have heard the last of it.  The uproar would have been deafening to our ears.

I have been able to show you how they tried to cover up the fact that they had colluded with my then Landlord, with the help of their attorney Alan Kerxton to throw me out of 8413 Ramsey Avenue in order to them to be able to take over the property for the Commuter store.  I have shown you the power point Presentation distributed by the Public information office showing the commuter bus was to be at the corner of Ramsey and Wayne Avenue which was the location of my office. .  I have shown you the 8413 Ramsey Lease  that was dated June 2006 and signed in June, 2007 after they were successful in getting me thrown out of the property at 8413 Ramsey avenue. I have shown you the letter Patricia Via sent to the Insurance company asking them to investigate her own crime.  As a footnote, up to this day I have yet to receive a result of the investigation Attorney Patricia Via requested from the Insurance company.  I wonder why?  Is it because she knew what the outcome would be?

If they felt that they did not do anything wrong why did they have a police detective by the name of Sgt  Kenneth Penrod call me to request that I sent all my emails to him for him to review before it went out to the public?  Of course the Detective later apologize.  An apology that I accepted because I knew he innocently was complying with the request of someone who was trying to get someone else to do their dirty work, and thereby possibly scare me into silence.

I have shown you the extent they were willing to go to including helping the owners of 8413 Ramsey Avenue, and my Landlord, the  Mayberys and Godbouts lift the stay afforded to me by the Federal Bankruptcy Act  through their Attorney Alan Kerxton.the  letter from Al Rosdieh I have shown you that their intent was to move into that space.  I wonder at times if they would have been willing to commit murder to get me out of the way?  Things that make you go hmmmmmm.........hmmmmmm......................

They have shop for Judges and succeeded in committing PERJURY to get the case dismiss.  But they miscalculated that there was a higher court that the case could be taken to. They Judged a Book by its cover by assuming that I did not have the education to let the world know the miscarriage of Justice in this case.   They forgot  that there is a higher court that GOD the Father Sits and Judges US HUMANS One by One.

It would have been easy for them to buy out my lease without resorting to destroying my life, but it would have been too right for them to do it that way.
